Is it okay to call up the lawyer who sent it to me or should I contact my lawyer first? I just want to ask certain questions, like how do you propose I transfer the domain to you? Open Question: What's the best way to deal with a cease and desist letter from a large corporation?

I own a few small internet stores. A couple of them have registered trade marks in their domains. Here is an example of what happened. To protect the names of the corporation and myself I will use the term BigCorp in the place of the actual company's name. I make it clear on our stores' websites that we are not BigCorp and that we are not affiliated with BigCorp. We just sell stuff that works with other items that BigCorp Sells. Let's say I own a store on a domain called BigCorpStuffForSale.com I then get a Cease and Desist letter from BigCorp who wants the following: Do the following and respond in two weeks to this agreement: You agree to 1. Cease use of all trademarks and logos 2. Cease making and or selling all items that bear or incorperate our trademarks and logos 3. Transfer all domain names that include the name BigCorp to BigCorp. 4. represent and warrant to BigCorp that the domains we found you using are the only ones that infringe on our name. 5. by no later than (two weeks) un-register all trade names with the name BigCorp with all government offices you registered them with. 6. represent and warrant the following information: a. tell us how many unauthorized items you sold while using our trademarks and logos b.Tell us gross revenue made on unauthorized item sales c. Tell us how long you have been selling unauthorized items d. Tell us who bought the unauthorized items and what they bought e. Tell us who made the unauthorized items. 7. Pay us 25% of gross sales of unauthorized products or $25,000. (Whichever is greater) You also agree that not following this agreement will cause irreparable harm to BigCorp and that you will be entitled to entry of both a preliminary and permanent injunction against you. You also agree to pay all costs incurred to enforce this agreement. You also agree not to do this again. Fortunately, I do not sell unauthorized items. I just sell items under a domain name that include BigCorp in the name and has their logo on the page. My plan is to do the following, please tell me if this seems OK: 1. Me, Mike, Joe, Andy, and yo2boy (and Dreggle) were hanging around #iamthewalrus when we realized we needed something to do. We thought of various people who had committed various offenses against humankind by being total idiots (E.G. the Club Penguin Wiki, Cheese CP, etc.) when we came across Mimo. Kid's gotta have something, doesn't he? We all agreed this was a good idea, and I declared a fatwa, which is pretty much a declaration of all out war. So, we waited for the next day. I got home from school and immediately went to whois.org. I looked up Mimo's two most popular sites to try to get info (no luck, he protected them.) But then I looked up a lesser known site-BINGO. There he was. We found it was registered by a certain Mike Mo**, (name deleted to protect identity), and we realized: His name is MIke MO**. Mimo! We were on the right track. We found out a greater reason for the war: He had bought over 90 domain names. Someone that spoiled really should get it. We started out simple; a few prank calls, a few unordered pizzas. We guessed to no avail. And that's where we still are, but making progress fast. Except then I found his picture. I Google Earthed his address, and, lo and behold, street view was there! I zoomed down to it and who did I see? THE BACK OF SOME KIDS HEAD, RUNNING INTO MIKE MO**'S HOUSE. To be continued when something more happens. more

I want to make a website for fun. I already registered the domain name and want to play around a little bit. I'd like to make a website regarding restaurants in my area of the state, maybe 5 or 6 towns that border each other. What I'd like to do is review each restaurant in detail (describing host, atmosphere, service food portions etc.). a whole review of our entire dining experience there. On each restaurants page, I'd like to include a link to the restaurants website, menu, comment on portion size, put info about coupons (whether they are on the website, get emailed to you if you sign up, get them in the sunday paper etc..,), where or not you get a free preappetizer like bread etc etc... . Also maybe add links to other review sites (yelp, zagats). On each page, I can have people comment on the restaurants if they've been there, maybe have visitors submit whole reviews and we can feature them as guest reviewers.. just a fun local site. These aren't tiny towns, but they aren't big towns either, maybe 30-50 restaurants per town? While it would be for fun, if it got enough traffic maybe i would add sponsor ads and see if i can make enough to cover part of the hosting price. There are only a limited number of domain names out there, at least before they start to degenerate into incomprehensibility, and unlike regular names, more than one person doesn't get to have them at any one time. I know there are laws against someone "cybersquatting" on your name if you have a trademark and they're trying to extort you to make you pay for it, but there are a lot of prime domain names out there that someone bought up WAAAAAAY back in the day, and just keep sitting on and doing nothing with. The one I'm interested in hasn't been used in at least four years (that's how long I've been interested in registering it), but the person who registered it keeps renewing their registration every year, won't give it up, and just leaves it sitting there doing nothing. Is there a way to legally make them surrender the domain name if they aren't using it, so someone else can put it to use?So, push the little jerk squatting on the land you want off the nearest cliff. A company has contacted me to say that one of my domain names is being used illegally by me and infringes on their's (misrepresentation). I don't believe it does, but they say they have an international trademark to prove it. I don't want to name and shame, but I need to know if they are correct? The EduCause site only lists one institution located outside of the US and accredited by a qualifying US agency. We have noticed a lot of educational institutions in India have a .edu domain name. Please let me know how we can register a .edu name also. Thanks in advance. more
